Government Customer Addendum

How this Addendum works. The TarmacSync Terms of Service apply unless this Addendum says otherwise. When your airport signs an order form for a paid subscription, the order form and this Addendum control together. This Addendum is built for U.S. public entities and airports — if a provision of the main Terms conflicts with your airport's governing law or procurement authority, this Addendum prevails for your account.

1. Order form controls

The signed order form — not the website pricing page alone — states your airport's plan, billing period, term, and price. Updates to the website do not modify the terms of an active paid subscription unless your airport agrees in writing.

2. Term and renewal

Paid subscriptions run for one year from the start date on the order form. At the end of the term, your airport decides whether to renew. Nothing converts or renews automatically. No termination fee or early-cancellation penalty applies.

3. No unilateral changes during a paid term

TarmacSync will not materially change the terms that apply to an active paid subscription without your airport's written agreement. Updated Terms may apply to a renewal term, future purchases, or free pilot use. This Addendum does not prevent TarmacSync from improving the product, provided the improvements do not strip features your airport paid for during the term.

4. Public records

Many airport and public-agency customers are subject to state open-records, freedom-of-information, and public-disclosure laws. Nothing in the Terms or this Addendum requires your airport to violate applicable public-records, open-government, or retention requirements. Your airport is responsible for determining what may be disclosed or exempt under applicable law. TarmacSync will work with you on reasonable notice if a public-records request involves TarmacSync materials.

5. Indemnification

Section 15 of the Terms (Indemnity) is modified as follows for government customers: the customer's indemnification obligation applies only to the extent permitted by your airport's governing law, charter, and procurement authority. If your jurisdiction prohibits or limits a public entity's ability to indemnify a private party, that obligation is void for your account.

6. Governing law and venue

Section 18 of the Terms (Governing law) is modified as follows for government customers: the governing law is the law of the state where your airport is located, to the extent permitted by that state's law. If your airport's procurement authority requires a specific venue, jurisdiction, or dispute-resolution process, that requirement controls.

7. Liability

Section 14 of the Terms (Limitation of liability) is modified as follows for government customers: TarmacSync's aggregate liability for a paid subscription is limited to the amount your airport paid for that subscription during the twelve months preceding the claim. For free pilot use, liability is limited to the amount paid for the applicable service, which may be zero. Neither party is liable for the other's indirect, consequential, or special damages. Nothing in this section limits liability for intentional misconduct, gross negligence, or where prohibited by law.

8. How to use this Addendum

When your airport signs an order form for a paid TarmacSync subscription, the order form will reference this Addendum. Your airport does not need to negotiate or sign this Addendum separately — it applies by its terms to government customers.
